EPCRA Tier II

The Tier II report is the annual hazardous-chemical inventory a facility files under EPCRA (Emergency Planning and Community Right-to-Know Act) by March 1, telling state and local emergency planners and the fire department what hazardous chemicals are on site above threshold quantities, generally 10,000 pounds.

In short: The Tier II report is the annual hazardous-chemical inventory a facility files under EPCRA (Emergency Planning and Community Right-to-Know Act) by March 1, telling state and local emergency planners and the fire department what hazardous chemicals are on site above threshold quantities, generally 10,000 pounds.

For most hazardous chemicals the reporting threshold is 10,000 pounds present at any time; extremely hazardous substances have lower thresholds. A distillery's ethanol inventory alone typically clears the threshold easily, which is why Tier II is a standing annual obligation. The filing wants each chemical's identity, hazards, maximum and average amounts, and storage locations, exactly the data a live SDS and chemical inventory already holds. Who receives the Tier II report?

Three parties: the State Emergency Response Commission, the Local Emergency Planning Committee, and the local fire department. The point is community right-to-know and responder pre-planning: the fire department should know how much ethanol is in which building before the call comes in.

How are quantities in gallons reported against a pounds threshold?

Tier II reports in pounds, so volume-stored chemicals are converted by density: ethanol runs about 6.6 pounds per gallon, so roughly 1,520 gallons crosses the 10,000-pound line. A facility storing barrels by the thousand is far past it, which makes accuracy of location and amounts, not whether to file, the real work.
